State regulation of natural monopolies and allowed in Kyrgyzstan

Regulation and control the activities of natural and permitted monopolies perform the competition authority and sector-specific regulatory agencies of the Kyrgyz Republic within the powers granted to them by the Law “On natural and permitted monopolies in the Kyrgyz Republic and other laws of the Kyrgyz Republic.

The competition authority monitors:

• all transactions, which resulted in the subject of natural and permitted monopolies acquire ownership of fixed assets or the right to use the basic tools are not intended for production (realization) of goods in respect of which the regulation in accordance with the Law “On natural and permitted monopolies in the Kyrgyz Republic, if the book value of such assets exceeds 10% of the cost of equity and allowed the subjects of natural monopolies on the last approved balance

• the sale, lease or other transaction which resulted in the entity acquires ownership or possession and (or) use part of the assets the subject of natural and permitted monopolies, intended for the production (realization) of goods (services) in respect of which the regulation in accordance with the Act, if the carrying value of such assets exceeds 10% of the cost of equity subjects of natural monopolies and allowed on the last approved balance sheet

• investments subject of natural and permitted monopolies in the production (sale) of goods for which no control is used in accordance with the Act and which represent more than 10% of the equity value of the subject natural and permitted monopolies on the last approved balance of subjects of natural monopolies and allowed must:

• produce goods and services referred to their areas of monopolies

• Harmonize the form of contracts for the supply (purchase) of goods and services, departmental regulations and rules of service with the competition authority

• enter into contracts with individual consumers (subscribers) on the production (realization) of goods in respect of which the regulation in accordance with the Law of Monopolies, where possible, to produce (sell) such goods and services

• provide the competition authority or industry body of state regulation of investment projects, business plans, current reports on its activities in the manner and within the time frame established by the corresponding authority.
